Terms of service
SIA "Before & After," registration number 40203586351, hereinafter referred to as the online store, provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.
1. GENERAL PROVISIONS
When a consumer purchases goods/services through the website, such an agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including but not limited to the Latvian "Consumer Protection Law," the "Regulations on Distance Contracts" of the Cabinet of Ministers of the Republic of Latvia, and others.
2. PURCHASES
The prices and specifications of products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most appropriate delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete the purchase by making the payment.
3. PAYMENT TERMS
The currency for transactions on the website is the euro. Purchases can be paid using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
• Latvian online banking payments: Swedbank, SEB, Citadele, and Luminor
• Visa/Mastercard payments
NB! When using the online banking payment method, confirm the order and click the "Return to Merchant" button.
The personal data required for making payments is transferred to the licensed payment institution Maksekeskus AS.
The contract takes effect upon the successful transfer of payment to the online store's bank account. If, for any reason, it is not possible to fulfill the order, the Buyer will be informed, and the amount paid will be refunded as soon as possible but no later than 14 days after receiving the notification.
4. DELIVERY TERMS
Goods are delivered to the following country: Latvia. Purchased goods are delivered using Omniva and DPD delivery services. All fees and taxes required for the delivery of the shipment to the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation. The purchased goods are delivered to the address specified by the Buyer within 2-5 business days. In exceptional cases, we reserve the right to deliver goods within 45 calendar days, informing the customer accordingly.
5. RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from the product within 14 calendar days from the moment of receipt. (Depending on the product, the Buyer may not have the right to withdraw, in which case the reason must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, the product must be used only for its intended purpose, and the consumer is responsible for maintaining the product's quality and safety during the withdrawal period. If the product is misused, damaged, treated carelessly, or not in accordance with the instructions, if the original packaging is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refund amount based on the product's diminished value.
To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: link, sending it to the email address info@beforeandafter.lv within 14 days of receiving the goods.
The Buyer is obligated to return the goods to the Seller without delay but no later than 14 days after submitting the withdrawal form to the online store. Upon receiving the returned goods, the online store will immediately, but no later than 14 days, refund all payments received from the Buyer under the Distance Contract.
The Seller has the right to withhold the refund until the goods or proof of return have been received from the Buyer. If the Buyer has chosen a delivery method other than the cheapest one offered by the online store, the online store is not obligated to compensate for the excess shipping costs.
The online store is not responsible for delays in the fulfillment of obligations or failure to fulfill them due to circumstances or obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell products and request their return from the Buyer if the price indicated in the online store is significantly lower than the market price due to an error.
6. CONSUMER RIGHTS FOR NON-CONFORMING GOODS
The online store is responsible for any non-conformity or defects in the goods sold to the Buyer that arise within 6 months of the delivery date to the client, or that existed at the time of delivery, unless such a presumption contradicts the nature of the goods or the defect. The Buyer must inform the Seller of any non-conformity without delay, within 2 months of discovering it, by submitting a complaint. The Buyer can submit a complaint by contacting the online store via email at info@beforeandafter.lv.
The online store is not responsible for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the rectification of the defects or replacement of the goods with new ones free of charge.
If the goods cannot be repaired or replaced, the Seller will refund the Buyer all payments under the Distance Contract. The Seller will provide a written response to the consumer's complaint within 15 days.
7. PROCESSING OF THE BUYER’S PERSONAL DATA
The online store processes only the personal data entered by the Buyer when placing orders, such as name, surname, email, etc.
The online store transfers personal data to the delivery service provider(s) to ensure the delivery of goods.
If you have explicitly consented to receive our marketing communications, including newsletters, we may contact you from time to time to inform you about our services and latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communications. The Buyer has the right to opt out of marketing communications by notifying us at info@beforeandafter.lv.
8. DISPUTE RESOLUTION PROCEDURE
In matters not covered by these terms and conditions, the Buyer and Seller agree to comply with the laws of the Republic of Latvia.
The parties will resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties will resolve the dispute in a court of the Republic of Latvia in accordance with Latvian law. Disputes between the Buyer (consumer) and Seller may also be submitted to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
The Buyer also has the right to apply to the European Union's dispute resolution bodies.
